ENGINEERING UNDERGRADUATE SOCIETY OF MCGILL UNIVERSITY EVENT BLACKLISTING POLICY Adopted February 2016, Amended March 2017, August 2017

Article 1: Definitions

1.1 The Engineering Undergraduate Society of McGill University (hereafter referred as “ EUS ”) is the registered name of the non-for-profit corporation representing the engineering and architecture undergraduate students at McGill University
1.2 The Board of Governors of the EUS is the administrative board of the Engineering Undergraduate Society of McGill University which is composed of Administrators as defined by the EUS Constitution
1.3 The EUS shall recognise all Departmental Societies, Clubs, and Design Teams set forth in the relevant articles of the EUS Constitution as EUS Groups
1.4 An event shall refer to any event hosted by an EUS Regular Member or Group, and intended for the EUS Regular Members.
1.5 The organisers include any individuals or EUS group(s) who are responsible for the planning and execution of the event
1.6 The staff include any volunteers selected or approved by the event organisers and are assigned with logistical tasks during the duration of the event.
1.7 The participants are attendees who are not responsible for any functional requirements of the event.
1.8 The plaintiff shall be the participant, staff or organizer that is the victim of alleged improper conduct
1.9 Blacklisting refers to a ban placed on an individual with regards to participating or staffing in any future event hosted by the EUS for a defined period of time.
1.10 Blacklisting may not be applied based on irrelevant personal characteristics such as race, gender, sex, religion, sexual orientation, handicap and others, as defined in Article 2.1 of the Charter of Students Rights’

Article 2: Improper Conduct

2.1 Improper conduct of an individual includes any action that endangers the well-being, physical or mental, of themselves and/or other people at the event, or if any damage is done to the property.
2.2 An organiser may request the blacklisting of a participant or staff that they deem to have demonstrated improper conduct during the event.
2.3 The EUS Equity Commissioner may request the blacklisting of a participant, staff or organizer that they deem to have demonstrated improper conduct during the event.
2.4 A plaintiff may request the blacklisting of the participant, staff or organizer that demonstrated improper conduct during the event.
2.5 The blacklisting request must be approved by the organizer of the event or the EUS Equity Commissioner.
2.5.1 The request must also be approved by at least one member of the EUS Executive Committee.

Article 3: Investigation and Verdict

3.1 At the first Regular Meeting of the academic year, an investigation committee is to be formed and be composed of the following;
3.1.1 One member of the EUS Executive Committee;
3.1.2 The EUS Equity Commissioner;
3.1.3 Two (2) to four (4) members-at-large.
3.2 The investigation committee shall be chaired by EUS Equity Commissioner.
3.2.1 The investigation committee shall be composed of no less than 3 members.
3.3 Upon receipt of the incident description by the chair and prior to the start of the investigation, the investigation committee members, including the chair, must evaluate the possibility of any conflicts of interest.
3.3.1 To avoid bias, members of the investigation committee, including the chair, should not have participated or played any role whatsoever in the incident.
3.3.2 The members of the investigation committee, including the chair, should declare any personal relationship with any of the parties involved.
3.3.3 Any member of the investigation committee may step down from the committee for the duration of the investigation by informing the chair.
3.3.4 At any point during the investigation, the chair may ask an investigation committee member to step down for the duration of the investigation due to conflict of interest
3.3.5 At any point during the investigation, the EUS President may ask the Equity Commissioner to step down from the investigation committee chair position due to conflict of interest for the duration of the ongoing investigation
3.3.6 The Equity Commissioner may not chair the investigation committee during the investigation for a blacklisting request they made but may chair an investigation for a blacklisting request they approved
3.3.7 Should the chair decide to step down, their duties shall be assumed by a member of the EUS Executive Committee that is already a member of the investigation committee.
3.3.8 In the event that section 3.2.1 is not met, the EUS Council shall nominate one or more temporary replacements to the investigation committee members that have stepped down.
3.4 The investigation committee must interview the individual accused of improper conduct. Failure for the individual to cooperate may factor into the decision-making process of the investigation committee
3.5 The individual accused of improper conduct must be evaluated by an impartial body.
3.5.1 The individual in question may raise concerns on the composition of the investigation committee to the chair who must properly investigate the concerns and take the appropriate actions.
3.5.2 Should the concerns be aimed towards the Chair, the EUS President must properly investigate the concerns and take the appropriate actions.
3.6 The investigation committee must interview the individual who requested the blacklisting, let it be an organizer, a plaintiff or the Equity Commissioner.
3.7 The investigation committee may question any participant, staff, or organiser who voluntarily comes forward with information on the incident.
3.8 During the investigation process, the individual accused of improper conduct is not allowed to participate or staff in any EUS events for a probationary period of up to four (4) weeks following the approval of the blacklisting request, as outlined in Article 2.4 and

3.9 The investigation committee cannot discuss any details of the individual or incident in question with people outside of the investigation committee and the EUS Executive Committee.
3.9.1 Access to the minutes recorded during the investigation shall be restricted to the members of the investigation committee and the EUS Executive Committee.
3.10 When a two-thirds (⅔) majority verdict is reached amongst the members of the investigation committee, a report with the verdict is presented by the chair to the EUS Executive Committee for approval by two-thirds (⅔) majority.

3.10.1If the verdict is not approved by the EUS Executive Committee, the investigation process is extended until the following EUS Executive Committee meeting.

3.11 Upon approval from the EUS Executive Committee, the verdict on the individual accused of misconduct is effective immediately. The investigation committee must inform the individual in writing of the decision, the reasons for the decision and blacklisting terms within 24 hours of the approval.

Article 4: Terms of Blacklisting

4.1 The length as well as other terms of an individual’s blacklisting are recommended by the investigation committee during section 3.8 and is approved by the EUS Executive Committee.
4.2 Temporary removal of an established blacklisting may be requested by the blacklisted individual pending the simple majority approval of the investigation committee and the ratification of the approval by the EUS Executive Committee.
4.3 If a blacklisted individual registers for an event without abiding section 4.2, the individual may be unregistered and not be refunded by that event’s organizers.
4.3.1 If a blacklisted individual has registered and paid for an event prior to the probationary period, they may be refunded and unregistered from said event.

Article 5: Blacklisting of Non-EUS Regular Members

5.1 An organiser, the EUS Equity Commissioner or a member of EUS Executive Committee may blacklist a participant or staff who is not an EUS Regular Member from future EUS events without an investigation committee, pending a simple majority approval from the EUS Executive Committee.
5.2 The EUS Executive Committee may reject an appeal from an individual blacklisted under

5.1. if the grounds for appeal are deemed insufficient.

Article 6: Maintenance of the Blacklist

6.1 A list of all currently blacklisted individuals is maintained by the EUS Executive Committee, under the supervision of the President
6.2 The list is relayed to the heads of all EUS Organizing Committees and Departmental Societies by the President within 72 hours of the approval of the blacklisting decision
6.3 A member of the investigative committee may report to EUS Council the decision of the investigative committee in broad terms and may not mention any names, location or specific EUS Group.
6.4 For decisions made under 5.1, a member of the EUS Executive Committee may report to EUS Council the decision of the EUS Executive Committee in broad terms and may not mention any names, location or specific EUS Group.

Article 7: Appeal

7.1 A blacklisted individual may appeal the decision of the investigation committee within 6 months of the notice given in Article 3.11. The appeal shall be submitted in writing to the President of the EUS. The grounds for the appeal must be specified.
7.2 An Appeal Committee shall be formed and chaired by the President. It shall be composed of another member of the Executive Committee, and any number of members-at-large as deemed appropriate by the chair.
7.2.1 Among the members of the investigation committee, only the Equity Commissioner may sit on the Appeal Committee as a member-at-large
7.2.2 Members of the Appeal Committee must evaluate any possibility of a conflict of interest, as outlined in Article 3.3.
7.3 The blacklisting decision is enforceable during the appeal process and may only be lifted by a simple majority decision of the Appeal Committee, subject to ratification by the EUS Executive Committee
7.4 The Appeal Committee shall review the relevant minutes of the investigation committee or relevant parts of the minutes of the Executive Committee meeting and re-interview the blacklisted individual.
7.5 The decision of the Appeal Committee following deliberations shall be final and binding, and no further appeal shall be considered.
7.6 The Appeal Committee must inform the individual in writing of its decision and the reasons for the decision within 24 hours from the end of the deliberation.

Article 8: Statute of Limitations

8.1 Any request for blacklisting for an incident that took place less than 6 months from the date of the request submission shall be addressed by: or
8.1.1 The investigative committee as outlined in Article 3
8.2 The EUS Executive Committee as outlined in Article 5.1
8.3 Any request for blacklisting for an incident that took place more than six (6) months may not be addressed by the investigative committee or the EUS Executive Committee

Article 9: Reference to Channels within the McGill Administration

9.1 In addition to the EUS Event Blacklisting Policy, if either party wants to go through an official McGill channel, the EUS Event Blacklisting Committee will refer the case to the appropriate McGill Administration, if the case falls under the Code of Student Conduct, the Policy against Sexual Harassment, or Policy against Sexual Violence or other policies not mentioned that may apply. The EUS Event Blacklisting Policy shall not impede official McGill channels and will work with the McGill Administration for a best resolution for all parties.

Article 10: Amendments

10.1 Amendments to this policy must be approved by a simple majority vote of the Board of Governors of the EUS

Article 11: Interpretation

11.1 In the case of a conflict between this policy and the following documents, the following documents prevail in the order they are listed in:
